Title 49 Code of Federal Regulations (CFR) Part 26 requires recipients
of USDOT federal-aid to capture, maintain, monitor, and report
contract data for Disadvantaged Business Enterprises (DBEs). The
regulations require that information concerning both awards or
commitments and attainments of DBE participation be reported.
Recipients must have a mechanism to verify that the work committed
and awarded to DBEs is actually performed by DBEs. In the attainment
section, recipients would report the actual number and dollar
amounts of payments made to DBEs during the reporting period.
Additionally, the regulations require recipients to maintain data
on availability of firms, automated directory of DBEs, annual
goal based on race/gender neutral and conscious attainment, and
prompt payment to subcontractors (DBE and Non-DBE).
